Car Insurance - Lending Your Car Could Land You in Jail

How many times have you said to the wife, children or a friend 'take my car' and not thought any more of it? Even if it's just a short trip down the road to the shops, you and the person you lend your car to, may be breaking the law! Furthermore if the person you lend the car to, in turn lends the car to another, you will be held liable for any damages caused by the other party, whether you were aware of their use or not.

If you own a car and decide to lend it to another person, it is your responsibility to check that the person you lend it to have adequate car insurance and that their cover extends to driving other vehicles. If you fail to make reasonable checks to verify these details you could be liable for subsequent damage that the person you lent it to causes, and indeed, you may find yourself on the end of a police prosecution for allowing an uninsured driver to use a motor vehicle contrary of section 143 of the Road Traffic Act. It is also you responsibility to ensure that the person you lend it to does not permit others to drive it.

In the United Kingdom, this principle was first established in UK law back in 1934 in the case of Monk v Warbey and Others. Mr Warbey owned a car which was insured to permit driving by himself and other members of his family. He lent it to his friend Mr Knowles who in turn lent it to a Mr May to drive. At some time during use of the car Mr May was involved in an accident for which he was deemed responsible, with a car driven by Mr Monk. Neither May nor Mr Knowles had insurance for third party risks and neither had the means or funds to satisfy the judgement in court against them. It was held that Mr Warbey had originally committed a breach of duty of sub section 1 of section 143 of the Road Traffic Act, by parting with the control of the car to a person who was not insured, and he was therefore held liable for all damages and costs.

It was found in court that Mr Warbey had been informed prior to parting with the Vehicle that neither Mr Knowles nor Mr May had adequate car insurance covering third party risks and had taken no steps to remedy this. Counsel for Warbey argued that the car accident involving May was too far removed from Warbey's breach of the statute to make Warbey liable for damages to the third party. The Judge disagreed and Warbey was found liable, and the principle enacted by this case remains in UK law to the current day. Up until this point in time the Act did not extend liability to users of cars to third parties, beyond the requirements of common law, but the decision in this particular case imposes upon the owner of a car, whether they have car insurance or not, an additional duty to injured third parties and enables any third party to recover damages from the car owner who permits his car to be used in such a way, knowingly or not.

The only exception to this rule is in the case of employees using a car owned by their employer, where the person driving the car had reasonable grounds to believe that insurance was in force when the used the car.

It would therefore be very prudent if you checked the levels of cover of your own car insurance policy before agreeing to the use of your vehicle by another, and indeed certify that they are covered by either your own or their current car insurance. Failure to do so could land you in the courts!

Q: Have you ever heard of Chubb auto insurance? I have my homeowners policy with them and they are pushing me to add my auto policy. Is it wise to have all of my insurance through the same company?

A: Chubb auto insurance is a very large, and well known, insurance company. As you know they also write insurance policies for homeowners. As far as we know Chubb is a reputable company. If they offered you a quote which you feel is a good price there is no reason not to use them.

How Do You Make a Car Insurance Claim?

Whilst car insurance is essential for all drivers in the UK, it's generally viewed as precautionary cover. Unfortunately for thousands of drivers each year, accidents do happen and claims will have to be made, so it's important to know what your rights are and how to pursue a claim.

If you're involved in a serious collision or your car is stolen, it's important that you contact your insurer immediately. In the case of a crash, you will also have to retrieve the relevant information (all insurance details, number plate, name, contact details etc.) from other parties involved. If a dispute arises it may also be necessary to call the police as well.

The claims process can take some time as all parties have to decide on who is at fault and determine the extent of damage. Therefore, the earlier you are able to contact your insurers and pass on all the information that you have available to you, the quicker it can start to be resolved.

If your car has suffered damage, the insurance company should provide you with a list of trusted garages to get an accurate estimate on how much repairs would cost. This quote will then form the basis of your claim, enabling them to provide any money that you might be owed to ensure that it is back on the road again.

In the event of a complete write-off, which would have to be judged by the inspector at the garage, you would be due the present estimated value of your car. This figure will take into account mileage, age and condition. Your insurer will then use market prices to determine a figure.

Insurance claims will also largely be swayed by the level of fault or complexity attached. If you crash without involving another vehicle, perhaps skidding on ice or having a tyre blow out at speed, then a claim should be a little more straightforward. Whilst you would have to surrender your no claims and pay whatever excess you may have on your policy, you will be able to manage the claim just through your insurer.

It becomes more complicated when other vehicles are involved, particularly in multi-car incidents. If there is doubt over who may have caused the collision in the first place all parties will have to submit their statements and blame will be attached after consulting all evidence. Sometimes it will be an open and shut case, liability can be assigned and your insurance company can seek all monies from whoever has been found to be at fault.

Further complications are added when there are injuries caused as a result of an incident. These might not be evident straight away - for example whiplash can take days to detect, especially following the adrenalin of an accident. The more people who are involved, in your vehicle and others, the more complicated it can come.

Whilst damage to vehicles is often easy to calculate (usually through trusted garage estimates), compensation for injuries can be far more complicated. If it has been a serious collision then all injuries will have to be taken into account. Once again, the party proven to have caused the incident (if indeed one can be determined) will be liable to pay the compensation through their policy.

This can run into thousands of pounds and will require specialist lawyers and solicitors working on behalf of all affected parties. Whilst you will need to maintain correspondence throughout the process, you can largely leave it to the insurers and legal teams to push this through on your behalf.

But as you can probably tell, there are a number of variables that can go into making a claim. Generally speaking, the more complicated a case is, the longer it is likely to take to reach a complete resolution. Depending on your level of cover and your involvement in the accident, you could have everything sorted out in a matter of days. However, many claims will take a number of weeks or months until all parties are fully settled.

Is Short Term Car Insurance A Useful Product For Students

Students home from college or university during holidays can create problems when they want to use a motor car to get about. Usually they are not independently mobile as a result of limited finances and the cost of insurance for younger drivers.

Their parents have usually committed significant financial resources to supporting them in higher education which, in most instances, does not leave enough to assist in the purchase and running costs of a car for the student. That can lead to a dilemma when the returning student asks for permission to borrow their parent's car.

They must have proper insurance which entails the parents contacting their broker or insurer direct to carry out a mid term adjustment to their annual car insurance policy to include the student as a named driver.

That takes a lot of time and effort, not to mention the additional premium for the adjustment. The worse bit from a parent's perspective is that any claim whilst the student is driving usually impacts on the parents no claims bonus, resulting in increased premium at annual renewal. Now you can see why it presents parents with problems.

Short term car insurance can, in certain circumstances, provide a solution to the parent's dilemma. The basis of the temporary car insurance is you can take out separate short term cover for up to 28 days by completing an on line, simplified application and making payment for the period selected.

The process is through the internet searching against the companies URL or search terms such as short term car insurance or temporary car insurance. The day insurance certificate can be printed off at home and the policy is registered with the MID.

In addition, most short term car insurance providers offer uninsured loss recovery as part of the insurance and one company offers dayresQ which is daily roadside recovery. The most important feature of temporary insurance, from a parent's perspective, is any claim under the policy does not affect the parent's annual policy no claims discount.

The policy is separate car insurance in the name of the student. It is flexible and can be taken out as frequently as desired even just for the odd day every now and then.

It cannot be all good news can it? Unfortunately it is not, there are strict age restrictions on most policies with the youngest age that is eligible of 21 years of age. The driver must also have had their UK or EEC license for a minimum of 12 months. Clearly this would exclude a lot of returning students from being able to take out the insurance.

However, it does leave most students in their later university years eligible and that may not be such a bad thing as they are able to borrow the car with a little more maturity under their belt. After all would you trust your 19 year old student with the keys to your car, I know my parents did not trust me to drive safely at that tender "I'm bullet proof" age.

So in answer to the question posed by this article, short term car insurance is a great solution to the problem of returning students wanting to borrow the parents car to take all their mates to Glastonbury, provided they are over the age of 21 years.

However there will still be the need to undertake mid term adjustments on the parents annual car insurance policy to insure younger students under the age of 21 years. As they say, you cannot have it all.
